PURCHASING

ACTING IN A PURCHASE

 

- Review of contract and Section 32

- Obtain searches of the title and necessary rate, planning and other property certificates

- Liaise with your financier to arrange funding for settlement

- We will provide everything that is required to efficiently transfer the property into your name

PRE-SETTLEMENT INSPECTION

 

We recommend that you arrange to inspect the property during the week proceeding settlement.

You are entitled to the property in the same condition and state of repair as on the day of sale

SETTLEMENT 

 

This is the day the purchaser takes possession of the property. 

We will arrange a time and location with all parties involved and attend settlement on your behalf 

POST SETTLEMENT

 

We will call you immediately after settlement to confirm once it has taken effect.

We will contact the agents and notify them of settlement and instruct them to hand over the keys to your new home

We will notify all relevant authorities including council, water authority, owners corporation (if applicable) of your details by providing a notice of acquisition making the process as seamless as possible for you. 

ACTING IN A PURCHASE

 

- REVEIW CONTRACT AND SECTION 32 

- OBTAIN SEARCHES OF THE TITLE AND NECCISSARY RATE, PLANNING AND OTHER CERTIFICATES

- LIASE WITH YOUR FINANCIER TO ARRANGE FUNDING FOR SETTLEMENT 

- WE PROVIDE EVERYTHING THAT IS REQUIRED TO EFFICIENTLY TRANSFER THE PROPERTY INTO YOUR NAME

VENDOR STATEMENT (SECTION 32 STATEMENT)

Vendors selling property in Victoria must provide a Section 32 statement. This document sets out the title, planning restrictions and other information relevant to the land. A contract will not be legally binding unless Section 32 is properly complied with. 

We will obtain important information online and compile a vendor statement in a speedy manner, enabling you or your agent to get on with the sale of your property.

CONTRACTS 

Contracts for the sale of land must be in writing. We prepare contracts to suit all types of properties in Victoria including off-the-plan and auction contracts. The Vendor has the right to determine the terms of a contract and we are able to ensure that a form will be used to the Vendor's best advantage. 

CONTRACT EXCHANGE

Once the contract has been exchanged by both parties, we will liaise with your mortgagee to advise them that the property has been sold. We will arrange for a pay out figure to be provided for your mortgage and make arrangements for settlement. 

SETTLEMENT

We will liaise with all parties and arrange a suitable time for settlement. At settlement any mortgage is paid out and we will arrange for the balance of monies due to you to be transferred in the most convienient manner as per your instructions. We will attend settlement on your behalf.

POST SETTLEMENT

We will notify all relevant authorities including council, water authority, owners corporation (if applicable) of the new owners details by providing a notice of disposition making the process as seamless as possible for you.

ACTING IN A RELATED PARTY TRANSACTION

Often related party transfers do not attract stamp duty. We will obtain your instructions, provide an estimate of stamp duty and registration fees (if applicable) 

 

We will prepare the Transfer of Land and online duties form, arrange execution of the transfer and other documentation and arrange stamping and lodging.

 

Once the new registration has occurred we will provide you with evidence of the new registration on title.

 

Lastly we will notify all relevant authorities including council, water authority, owners corporation (if applicable) of the new owners details by providing a notice of disposition.
